If you suspect that you, as a consumer, are subject to unfair contractual terms by the manufacturer, seller or service provider, EU LAW FIRM shall offer the assessment of the terms of the contract as well as the protection of the rights of the customer.
A couple of signs that you may be subject to unfair contractual terms,
-the terms of the contract were not negotiated, which means that the contract was drawn up in advance or is a standardly created template contract, and you, as a protected consumer, were not given the opportunity to influence the content of the provision, which directly affects or limits your rights
-the consumer's legal rights are unfairly limited
-the terms of the written contract are formulated in a vague, inaccurate and incomprehensible manner
-the terms of the contract are contrary to the principle of equality of the contracting parties, or law that the contracting parties are subject to
-disproportionately high contractual penalty or compensation in the event of non-performance of the contract or incomplete performance by the consumer
-where the seller, manufacturer or service provider is able to unilaterally withdraw from the contract but the consumer is not given that opportunity
-a disproportionate increase in the price of the subject-matter of the contract (compared to the primarily negotiated price) from the seller, manufacturer or service provider without warning and the possibility of cancelling the contract or negotiating the new price
-the consumer is obliged to fulfil all contractual obligations, but the seller, the service provider, the manufacturer does not fulfil his contractual obligations, or the terms for fulfilment significantly differ and are disproportionate for both parties
If any of the above features, or similar problems arose as a result of concluding a contract, EU LAW FIRM lawyers will help to assess the compatibility of the terms of the contract, will assist the client in referring the matter to the party who has applied unfair contract terms and engage in negotiations, will assist the client in legal action.
