Since 1 January 2021, EUTM and RCD Regulations will no longer apply to the UK. As for representatives who have lost their capacity to act before the EUIPO as the result of the end of the transition period shall be 1.) automatically removed from all files in EUTM and RCD related proceedings, 2.) deleted from EUIPO’s database of representatives (if applicable, from the Office’s list of professional representatives), 3.) will not be able to send mail in relation to a file through the EUIPO’s “UserArea”. For proceedings initiated after 1 January 2021, UK companies shall appoint a European representative before the EUIPO. The main changes that shall be noted by UK companies after Brexit:
Rights holders domiciled outside the EU/EEA shall be invited by EUIPO to appoint a representative in case of necessity. The case of necessity shall be when the right in question already is or becomes subject to the proceedings before the EUIPO.
Rights holders domiciled in EU/EEA shall not be invited by EUIPO to appoint a representative, thus if proceedings before the EUIPO are initiated after the end of the transition period (from 1 January 2021), the right holder shall appoint a representative on their own. In case of failure, EUIPO will notify any communication or procedural document directly to the rights holder domiciled in thw EU/EEA.
No notifications shall be issued by EUIPO to EUTM and RCD applicants, right holders and professional representative outside pending proceedings before the office.
Representatives who lost the capacity to act before EUIPO as a result of the end of the transition period:
- are automatically removed from all files in EUTM and RCD related proceedings;
- are deleted from EUIPO representatives database (if applicable, also from the list of professional representatives);
- will not be able to send mail in relation to a file through EUIPO "UserArea";
- shall make a local copy of their relevant data contained in "UserArea".
